Laid Off - Entering US Again...

Hi,

I was working for a company 'X' in US. I revalidated my visa while working for company 'X' (stamped on my passport, valid until 2007). I got laid off in April and went back to India and joined company 'Y'.Company 'X' cancelld my H1B I think. The Company 'Y' wants to send me to US. What do I require.

Can I travel with the visa stamp on my passport along with supporting H1B documents from the current employer?

Can I travel to US and start working immediately while my current company filing for 'H1B'?

How do I check whether my H1B is cancelled or not? Is there any site? (If I have the receipt no)?

If u have new H1 approval

and employment offer letter, it is better to get another h1 stamp at home country consulate than to risk entering US. Per AC21 you can show a valid previous employer stamp and approval from new employer and enter US. Make sure that you get your I94 with the current employer's name.

Coming in to US in another company's h1 and then doing h1 transfer is intent to fraud INS. moreover INS might require you to give recent paystubs in order to do a h1 transfer.

There is no way(available to public that is) to check whether a H1 has been cancelled or not.
