Labour substitution

I Filed 140 using labour substitution in VSC. There is a mismatch in the educ. qualification. The LC says B.S. Computer science 3 yrs exp. but I hv 7 yrs exp and my education evaluation says
B.S electrical engg with specialisation in comp engg. Wl there
be any RFE or problems in I-140 approval. If anyone knows abt this pls reply. Wud be helpful.

50-50 chance, as your lawyer mentioned to you under current economy. Major of education has to be convinced to authority, if required, otherwise, technically, You Are A Computer Professional.

Thank you assur! My attorney told that i should not be surprised if 140 is denied and there is also a chance that i may get it.
She advised me to do a back up labor too as they don't hv evidence to prove that there is a match in the educ. qualifn.
but will try to argue with INS. Let's see. Tks for ur input.
 
If you don't see 'equivalent' word under 'education qualification', then it is certainly a problem. Remember labor substitue cases gets more scrutiny than regular cases.

RFE I-140- Civil Engineering degree is not related to Computer science!?

I got a query on my i-140, (LC-substitution) here are the details:

RFE I-140- Civil Engineering degree is not related to Computer science!- Substitution?

LC requirements:
#col14(degree) :Bachelors degree - 4 yrs.
#col15(Major study): Csc degree or related
no. of yrs experience: 2 yrs.

My Qualifications:
#14: Bachelors degree in civil engineering - 4yrs
experience: 8 yrs.

In my RFE, USCS advised saying civil engineering is not related to
computer science degree.

My lawyer already sent a letter stating DOT reasons (AOH-Handbook of DL) & atttached copies from the handbook to USCIS.

Do you ppl. think this 1-140 will get approval?
