I am working for a comany X which has two products or business units. One of them was not doing good and other was not so so they split the company into two and both under the same group but each company has their own tax id's.Now we have X and Z companies.I have my H-1 with company X .
My labour was files with company X and i got information that the LC is approved(federal) and the company X is going to shut down may be in another 3- 4 months.Since my GC was underprocess i was kept on the rolls of company X.
Q1. Can i transfer my labourcertication approved to company Z.Is it possible for transfer ?if so what should be done?
Q2. Or can i still be in the rolls of Company X and .so i be a sole employee and pass the next stage of my GC.

Since X and Z are the same company Z is ready to do anything for my status.

Can u please advise what should be done?

If a company has been acquired, merged or had a significant change in its ownership, the new or reorganized entity is generally considered a successor-in-interest ("Successor") to the originally existing company.

In the immigration law context, the Successor is required to submit documentation evidencing that it has assumed the rights, duties, obligations and assets of the original employer and that it will be liable for the employment of the beneficiary subject to the terms set forth in the labor certification and I-140 Petition. Similarly, a company that changed its name or corporate structure would need to meet these requirements.
