I have a unique problem. My H1B Visa is set to expire in July 2006. My Employer just applied my Labour Certification in Feb 2005. I would like to return to India since I have some matter to attend to there and would take me well beyond July 2006 to come back. Just wanted to know if someone files a new H1B for me in future, will there be a problem in getting the new visa in India? Since Labour Certification had been applied once, will this be recorded as my intent to immigrate permanently and will this be a cause of rejection for getting my visa?
Would appreciate an early response, as have to plan quickly.
