Hi All,

My employer filed labor at end of last year with RIR from Arizona state. Arizona Dept. of Economic & Security has sent letter to Attorney which states as below :

"This is to notify you that on April 20,2005, your petition for labor certification of permanent employment of aliens was forwarded to the Dallas Backlog Processing Center. This is in accordance with the new PERM regulation published in the Federal Register(69 FR 77326),which re-engineered the permanent labor certification system."

And it also shows Priority Date as 1/3/2005.

My 6 years of H1 are also completing on 1st November 2006. So I would like know what will happen in my case?
Should I change my case under PERM which attorney says that let's wait for while and will decide.

Can I anyone please suggest me where my future lies in this big journey of Green Card ?

thanks
bs

ANSWER TO YR QUESTION:

YES - CHANGE IT TO PERM -ASAP

Should I change my case under PERM which attorney says that let's wait for while and will decide. ATTORNEYS HAVE TENDENCIES TO DELAY THINGS , EXPECIALLY WHEN THEY DON'T KNOW WHAT THEY R DOING ;-)

thanks greatgc for you reply.
So how much time will take in current situation ?
Do we get any state preference in back log center ?

thanks

Before changing it to PERM, see to it that your RIR Application has met all requirements of PERM,
ie, 1) Prevaling wage from SWA
2) Notice of job opertunity at work location
3) Two advertisement in Sunday Papers / One in Sunday One in Journel
4) Job Posting in SWA
5) 3 alternative Job advertisment ( employer webSite or Job serach webSite or Private firms or local ethnic news paper

If all this Criteria are fulfilled then only otherwise let that application go as it is to avoid rejection???

I spoke to my lawyer & my employer and it seems noone is interested in refiling case under PERM. Since we are big company and there are so many filings going on with other employees and all are done through regular procedure before Jun28. I think company is not willing to spend again hectic time in all this stuff. So I'm just thinking to wait and watch.
What do you suggest ? Do I need to put more request/pressure on employer ?
