Labor Substitution

Labor Substitution: Sometime when a company files a labor certification for its employee it is not further used by the company due to many reasons; termination, laying off etc.

In most cases the labor is approved if filed appropriately. But since it was never used for the same employee it can be used for another employee of the company providing hois qualifications and experience are a close match to what is mentioned on the certified labor. So company and employee get this benefit of having the labor already approved so they can go to I-140 stage directly.

This process is called labor substitution although it should have been called employee subtitution....hahahaha

I agree employee Substitution is much more civilized than Labor Substitution but much more better than the "alien".


Is it possible to use the approved labor certificate in another state. what I am trying to say is - If My company field for Labor in state A and company moved to state B before labor was approved. Is it possible for me to use the Labor approved in state A to file 140 in state B. state A and B fall under different Processing centers? please reply.

It is my understanding that labor certification is not only company specific but also location specific. So logically one may not be able to use LC approved for one state to file I-140 from other state
 
I Hope state doesn't matter

I'm Labor Substitution - The original was from MA but I work in WI. However the head office is in MA - but I work for a branch in WI. I hope it gets approved else I've just wasted almost a year.
