Hi,
I know a company willing to give me a substitute labor.I wanted to know can we directly file I-140/485 if my skill sets match?

I heard that first step with usine substituted labor is to get the approved labot transferred to our name which might take 4-5 months. Is that so?

Please let me know if anyone has gone through labor substitution? How much time did it take to transfer the labor in your name (if it's needed at all).

Regards..

Correction: You can't file 140. Employer needs to do that. He/She also needs to send a request to USCIS regarding substituting the beneficiary on pre-approved LC.

Also, "unitednations" is right. There is not such thing as transferring the LC.

You can file 140/485 right away. labor certification is not specific to a person, it belongs to the employer. There is no such thing as transferring to your name.
