Labor Substitution requirement

Hi,

My company has a pre-approved labour, what are the things I need to consider to qualify for that.

--- Make sure LC is NOT used
--- Check the ETA 750A, ETA750B and find what is required in column 13, 14 and 15 (Approved LC will have approval letter from DOL with DOT code and form ETA 750A and ETA750B will be attached to it)
In column 14 you will find what education, degree they require and experience and in column 15 you will find other info what they will accept.
Note the date when LC was filed.
If you had the education and skills and exp required in 13, 14, 15 BEFORE the date LC was filed then you can substitute the LC. It is difficult to advice with out looking at your degree, exp and skills and the approved LC copy. Better take your papers and the approved LC to a good lawyer who can give you a good advice if you can qualify to use that LC

Hi Ginnu,

May I ask you a question. If the old LC has been used for I-140 and the I-140 has been approved but i-485 has never been applied, can the LC still be substituted?

This is gray area and AC21 regulations are not published till date and AC21 memo does not say anything regarding this situation. Better not to use that LC because the employee may have filed I-485 and employer may not know. I will not use that LC
