- I am currently on 7th yr. extension till 07/2007
Labor filed thru RIR on 03/2005.
- Is it advisable to transfer to a company who is willing to substitute labor from 2003? What are the risks, if any?

They said with that labor, my I-140 will get approved in 2 months & I can get greencard in 2 yrs.

All advice/thoughts appreciated!

you need to verify or ask lawyer to verify the authenticity of pre-approved labor.

Talking about grreen card, it depends on which country you were born and which EB category you are on.

Thanks GotPR?

- Let's assume the labor is valid for my job role.
- I was born & citizen of India
- Will apply thru EB2 (as I have MS from US college)

How will labor subtitution pan out in this scenario?

Regards.

You can file I140 and probably it will be approved soon, but you can not file I485 immediately as cut off data for Indian EB2 is July 2002. YOu need to wait cut off date reaches PD of your sub labor which is 2003.
