Just try to find out the reason for denial. They should tell you that and also be cordial to them and ask them if they plan to appeal .. or better still find out what they plan to do about it.

Hi Friends,
Something back i started this thread, because i was thinking i was in trouble and my case was not filed properly. and i asked my lawyer but he was not giving complete information. so i requested FOIA to get all my info. Based on other input here, i lost hope on my case.
with god's grace and well wishes my 140 got approved today. see the details of labor sub.
I have Bachelore of Engineering 4 year degree in Electical Engineering and 5 years of Experience.
and labor sub details are below.

Something predictions are good, because of this i was trying different ways like filing FIOA to know more about my case and arguing with lawyer to file a new case.

Hello,

My situation is exactly similar to yours except that my I-140 is still pending (pls see signature). Btw I have fully exhausted my 6-year H1-B and now working on EAD. From what I understand based on your case I should now expect a denial instead of an RFE... keeping my fingers crossed as I have a 3 year B.Sc. degree and the labor mentions a 4-year bachelor's degree.

It would be informative if you could post your I-140 LUDs.

It is strange about my settings, i am not able to see your signature. It happened before also. please send your signature as message.

And regarding LUD for 140, there were no LUD's for 140 at all, it was approval directly.

What is the your PD date ? is it the date on the substitue labor or the date of filing your I140 ?

Strangerr and Others with a substitute / pre-approved labor - please post your details too.

If you have seen the Labor - it should have the date mentioned in the right side bottom corner.

It will mention the date when State (SO) recd your case.
That is the Priority date.

The Priority Date would also be mentioned on your approved I140 .

Sub Labor

One of my friends is going to use pre-approved labor from his employer. Original labor requirement says education should be "B.S in computer science or Computer Engineering or related field " and experience should be one and half year in network engineering. My friend has B.S in Electrical Engineering and 5 years of expirience in the network engineering. Can he go ahead and use this labor?
 
I guess he can. Be sure to get a edn eval done to show that Electrical Engg is related to Computer Engg...I would say ask him to get a edn eval done from Trustforte...they do a pretty good job with this.

Here is a edu eval done by trustforte where they show equivalence between electronics and computer related degrees. Electrical should be no different. Ask your friend to get such an eval done and then only apply.
