Hi,

Please help me.

What is the correct process for the Labor Certification filing? My employer started my GC processing and the advertisement was gone and completed its tenure in the last week of the Dec'07. I was asking my attorney when he is going to file for LC, he replied to me saying that, After the closed of the job advertisement period i need to wait for another 30 days. Anyone there please reply.

Your attorney is right! There is a 30 day waiting period after the recruitment process before submitting the PERM application.

Is Alien Employment Certification (AEC) same as Permanent Employment Certification, which involves filing ETA Form 9089 ?

There are a lot of different advertizements/recruitments steps that must be followed in order to file a PERM case. It must go on the corresponding state's job bank for 30 days, there must be 2 newspaper ads, there must be a job opening notice place internally for 10 business days, and there must be 3 additional forms of recruitment taken such as employer website, job website, campus placement office posting, job fair, employee referral program, etc. The case can be filed 30 days after the last recruitment step has been taken, providing that your employer has interviewed all the applicants and determined that none of the US workers qualify for the position being offered to you. There is a provision that allows ONE of the additional THREE recruitment steps to be within the 30 day period when filing.

I would assume the 2 are synonomous. There are several ways of referring to a PERM Labor Certification and its encompassing steps. "Application for Alien Employment" could be synonomous, as I've heard it used before. Most commonly, it's referred to as "LC," "Labor Cert," "PERM Application," "PERM Labor," "PERM Labor Certification," "PERM ETA," "ETA forms," etc.
