Labor Premium Processing?

Hi guys,

I'm just checking if we have a Labor processing in Premium. One of my friend said it is available. Please confirm if any one knows or has applied for. I am on 6th yr with 6 months left and trying to opt for a Labor with Premium and then I-140 Premium. My current I-140 is just denied.

There is no such thing as premium processing for labor certification, there is one for I-140 but for people whose h1b is expiring within 60 days

Do you think the 6 months time is good enough to process the Labor and I-140 premium approval, if I start the process ASAP?
 
Going with statistics, I dont think 6 months is enough for processing of labor and I-140, at the same time you dont have any other option left other than to leave country, AC21 requirement to extend beyond 6 years h1b is either labor certification should be initiated before start of 6th year h1b and could be pending (1 year h1b extension) or approved I-140 (3 years h1b extension). As of currently labor certification is erratic with reengineering and Atlanta center processing all PERM's. BTW what is the reason for I-140 denial, may be you could file appeal or MTR. wish you good luck

I got the "denial notice sent" notification yesterday and hoping to get it in the coming week. I filed I-140 & I-485 conc last July 26th TSC. Both have been denied including dependents. What ever the reason, I'm going for MTR but on the safe grounds wanted to have another Labor processed. Do you suggest of doing this or waste of money? How long does the decision on MTR response would take? If MTR gets denied then do I have any other otion?

The other question is: My H1 expires in 6 months. Can I file H1 extension at the same time while responding to denial i.e., MTR? So they might approve H1 for 1 yr while MTR is pending.

I would have happily gone back to home country but bought a home just a year ago. I can’t sell it so fat in this tough market.
 
File MTR, in that way I-140/485/765's would be reinstated, and simultaneously file new PERM from a different employer by properly addressing the denial reason in new perm. I believe based on MTR you should be able to extend your h1b

Your friend is not correct. There is no premium or expedited processing available for processing a PERM petition.
