I am writing this on behalf of my friend. Here's the scenario...

2002 January filed Labor in RIR

2002 Nov. RIR Denied, got a letter to file in Non-RIR

2002 Dec filed in Non-RIR

When checked with DOL recently the representative said his case has been de-activated.


My question is,

What does the term de-activated means ?

Is there a way to activate again ?

His H1 expires (6 years cap) on Mar 2004, Is he elligible for H1 7th year extension.

-------- Check with the lawyer who filed LC, the reason for this and he can explain you in plain language

My question is,

What does the term de-activated means ?

Is there a way to activate again ?
----- Ask the lawyer he might have received letter from SWA or SESA or DOL

---- According to your info posted above, even if his 2003 Dec filed in Non-RIR LC is activated he does NOT qualify for 7th year extension, if the lawyer says that new Non RIR LC is activated and shows proof and he recaptured the old PD then some ray of hope, I don’t think he captured the old PD of LC that was filed in 2002 because it was denied. I don’t think you have chance for 7th year extension

He is trying to talk to the lawyer. It looks like the lawyer is not co-operating.

The priority date remains same right from the 2002 Janyuary filing. In that case, Is there a possibility for 7th Year Extension ?

One needs the full details in such cases, he should find a good lawyer and get his file back from the lawyer who is not cooperative, new lawyer can also get his file back from lawyer. You may consult JIM and can find his info, email in many threads or any good lawyer
