but if let's say i'm working in state A in an office for the company and they have a headquarter in state B. state B is faster with Lc than state A. can I apply my lc in state B although my office is in state A and my checks are calcualted according to the taxes of A? can u explain pls?

Ye. Also, if possible start generating payroll from State where LC gets approved first. Life will be easier at I-140/485 Stage.

USNYCUS,

Why you say life would be easier at I-140/I-485. Because I am in the same boat and would like to know more. According to my info. LC and GC process is for future job.

Thanks

Agree, LC is for future job.

But at the same time it also requires:
a) Beneficiary intent of joining the employer after approval &
2) Employer ability/willingness to hire beneficiary at approval.

Both are comparatively easy to prove if you are already working for employer as attested in LC. I am not saying that you won't get GC if you decide to join employer later but chances of getting RFE are more.

1-so r u saying that if my work is in state A and state B is easier for lc, and my employer has its headquarter in state B, and I file my lc from B i should also have my paychecks coming from state B?

2-second would INs have a problem with me when applying to i140 and i485, if i work in State A but my labor came from state B?
