Labor Denied

Hi,

My lawyer has file LC for me in EB2 category and it was denied. My lawyer thinks it is a comupter gliche and upon refiling it again, it will go through in the second time. Does any body faced this issue ever? What if the re-filing also failed, is there a waiting period, to file it fresh again in EB3 category?

hi,
i am also in the same situation. my employer filed in eb2 category and got returned. he told he ll be filing motion to reconsider. he told it might atmost take an year to get a response. I am not sure if its worth waiting or to apply in eb2 newly. Any ideas/ suggestions ??

Yes. There is no waiting period to re-file as long as the recruitment is still current. If it is expired, your employer will have to do new recruitment. Sometimes if it's a stupid error or glitch and they deny it, it's best to refile, as R4R's are taking foreverrrrrr. On a site note, EB2's are being audited and carefully scrutinized, so it could be something related to that or business necessity.
