Labor date or 'request for reconsideration' Date

Hi

I got a denial when I filed for my labor(under perm) and a request for reconsideration was sent to Balca by my lawyer.

What date will be used at the time of h1 6th year extension -
1. Original Labor date OR
2. Date on which 'request for reconsideration' is sent.

Even though my original labor date is a year old but 'request for reconsideration' date is not. :(
