Labor Cleared, filing I-485/140 concurrently

Hi, I just cleared my labor and went for the medical to an american doctor, which ofcourse gave a +PPD. So my case is stuck since I have to go for more tests.

Is it possible for me to take a second opinion from an indian doctor at this time ?

which doctor u went??Is he/she is a civil surgeon or your primary care physician??If u are positive to TB test then u have to take X-ray for TB test.Other than that U have to take the following vaccinations.

1.MMR(Mums,Measles,Rubella)
2.TB test
3.Tetanus
4.Vericella(Chiken pox)
5.HIV test

In this forum i dont know nobody is helpful.I just got my labor cleared and asked for Documemts regarding I-140/485,but nobody is giving.


Guys help for the new coming guys!!!

As Kabish mentioned only the Civil Surgeons (Listed on USCIS website) can do this test and they seal the result in an envelope that you have to submit with I-485 package ?(your primary physician cant give you this and it doesn't cover under any health insurance as far as i know). You can't goto just any doctor for that and if your TB test is positive then you have to take Chest Xray and all.

If you have done the vaccinations in the past then you can show the record or you can just get those shot again or if no proof then you can get your blood tested for those antibodies. I would say get the vaccination and save time.

Just check the list and you maybe able to find Indian doctor that can clear you up ...

Its not an indian doctor and not my primary care phycisian. My PPD did come positive and then i took an x-ray with my primary care doctor so all that was fine, untill he was unable to diagnose the x-ray and then refered me to a specialist.
now the problem is that while that specialist is doing his tests and all, the primary care doctor has to close the final dignosis and return back to the immigration Irani doctor, then only he will give me the sealed letter to i can submit it for I-485.

So i am kind of stuck till this diagnosis continues. I know another Indian doctor who clears up easily but havent talked to him. Do these immigration doctors also report these results to INS directly , does anybody know ?
Can I take a second opinion and move forward with the filing or I-485, while the medical diagnosis takes its own time.
 
Hi abhir,

You can file I-140 which does not need and depend on the medical test.

Once your Medical diagnosis is through you can file the I-485/EAD/AP using the pending I-140 receipt. This will help you to start the clock ticking for the I140, which currently takes atleast an year to get approved.

But my lawyer is saying its good to file the I-140 and I-485 concurrently.....!! Is that good ?
Somehow its difficult to trust even the lawyers at times.....Please advise.
 
Yeah it is good to file concurrently. But your case is different. Why waste the time. Even if you file 140 and later file 485 when 140 is pending, it is considered to be concurrent.

Dont wait. Go ahead and file 140 while your medical goes through. There is always no harm in doing this.
