Labor Certified and travelling abroad with I-140 pending.

Hi,

My labor just got approved. :D And I am filing my I-140 next week.

I am on my 8th year H1 extension. My visa expired in May 2006 and I-94 is extended till May 2007.

We are planning to travel to India during Nov 2006 and we have a visa appointment in Dec 2006 at Chennai. (My wife is on H4).

Are there any issues to travel abroad when I-140 is filed and pending ?. I mean, H1 extensions are made possible based on labor pending, now that it got approved, would we need to postpone the travel plans for any reasons ?.

Even I am also in same situation but I never thought of this. What makes you to think that you can not travel when you have valid VISA?

why would it a problem. You have approved H1 and related all H1 document which is enough at embassy to get your visa. having approved I140 is till very good case, that shows your immigration stage is on further more advanced stage. If possible also take a copy of approved I140 petition.
