My friends company is applying for his Labor. He is being payed 80000K, and the lawyer says that they only can apply in EB-3 because salary is pretty low compared to EB-2 standards even though he meets the expeerience related requirements for EB-2.
If this is an issue, is it possible for the employer to increase his salary now to be able to file in EB-2 ? DOes the law states that you can only show the salary you were offered when you joined the company ??
