Hello All, need advice on Labor certification.
I am working for a company xx in dept yy. Company xx is planning to sell the dept yy to company zz. My H-1 & labor is filed by company xx in San Francisco, California.
My question is if company zz takes over the dept yy, can new company take over labor processing also.
If company zz buys the dept yy & setup the dept xx in some other state or city, In that case do I have to start the labor all over again ?
Any advice on this is much appreciated.

Thanks
rbhan

If the department stays in same place , current LC process can be continuied. But if they move out of state ( in some cases even in same state but other city) new LC has to be filed.

That will be a bit tricky. gp111 has mentioned point which has to be taken care of.

Apart from that find out if that department was a separate entity financially(looks likely) - had separate budgets etc. In that case - try to find out if new company is taking care of all assets and liabilities of that dept. If that is the case then LC can be carried forward, provided conditions stated by gp111 is also met.
