hi,

i'm workin for a company in state A, but the lc processing is very slow in that state. can my company apply for my lc from a state B where they have their headquarter bcs the processing is faster?

if this is feasible :

1- can u explain exactly how to do that?
2-should my taxes be paid according to state B law where i'm not working?
3-what should i put in the advertisment about the work location ?
4-will Dol suspect this ? is it a trick or it is allowed by law?
5-how will it affect later the I140/I485 stage?

regards,

... You need to file another LC from the company HQ (State-B).

2-should my taxes be paid according to state B law where i'm not working?
... Not required, but it's not a bad idea.

...It's allowed. One can file multiple LC.

5-how will it affect later the I140/I485 stage?
... It won't affect I-140/485

My company is a Non Consulting Company and I would like to get my Labor cert filed from an another state since the state I currently live has very long delays.

My company's parent company has a branch in another state which has much faster processing time. Would it be legal to file through the other state and what are the implications?

My company may do this as long as it is legal and completely "honest".

I have seen consulting companies do this but not a non consulting company. In my case the state that I am trying to file from is the branch of the parent company hence the confusion.

Thanks, any help is appreciated.
