Labor certificate and EB1

Hi, All,

I am considering to ask company to file labor certificate for me. My EB1 extraordinary ability I-140 petition was filed six month ago. In this way, in the case that my EB1 petition is denied, I could use Labor Certificate as backup. The question is: is there any problem with this double petition (one is with INS and one is with local state Department of Labor)? Thanks for help.

I heard that the RIR will not be available later this year and it will be replaced by so called PERM???? It is true and which one is better?
