L2 to H4 -out of status

I was on L1A till Oct-07 and i started working on H1B from Nov-07. After i started working i have applied for status change for my wife. Attorney has applied under Nunc Pro Tunc and she got reciept number also. My wife's I-94 based on L2 got expired, my advocates says my wife's status should be changed to H4 before 04/01/08( 180 days) otherwise she has to leave the country and get the stamping done from India. As per Vermont center processing dates, there is little/ no hope that her application gets processed before 04/01. Now she is pregnant and can't travel, Please suggest if there is any alternative so that she can stay back here till her status gets changed.
 
She has to file change of status when her I-94 was valid. L2 based I-94 is valid when you were on L1.
No need to get COS approved within 180 days.
