I am on L1 in USA. I-94 expiration is Aug 2011. My wife's L2 EAD expires this April 2011. She is currently working and had applied for EAD renewal in Dec 2010. She is yet to receive the new EAD card. Her I-94 expiration date is again Aug 2011. So, she will most probably get the renewed EAD with the same expiration date.
My wife and I are planning for a vacation to India in the month of April. We will be back to USA by April last week. We will be applying for our I-94 extension in the same week. Hopefully we should get our new I-94 by July 2011. Once we have the new I-94, She will be applying for another EAD renewal with the new I-94 expiration date (should be most probably Aug 2013).
Question: When she applies for EAD renewal in July 2011, she will hopefully get a renewed EAD by September 2011. Between Aug 2011 and Sep 2011, she won't technically have a valid EAD. Can she contine to work during that period?
Please help. What can be done to avoid this?
