L1B to H1B transfer with a prior H1B

I want to switch my status from L1-B to H1-B with a new company. I also had a H1B prior to L1B with the current company & the total 6 years of the old H1B will expire on 2007.

Does H1B Cap is applicable during L1B to H1B transfer even I had a prior H1B?
