L1B to H1B,not applied for H4

Hi,

My husband is in L1 blanket & i'm in L2 visa, now he applied for H1B waiting for approval. Till now we dint apply for H4 visa. My doubt is after getting H1B approval if his former employer withdraw his L1B petition will i go out of status as we dint apply for H4 visa?

Urgent advice needed.thanks.
 
Out of Status

You lose your L2 status when H1 start date comes. So you will be out of status if you do not apply for H4 visa.
