L1B-->TN-->GC - Canadian Citizen ( Born Indian )

Hi All,

I have been following TN threads from long time, now My company has agreed to process My internal transfer to US on L1B visa plus they will start GC process within 2 weeks and also file for H1B every year.

I have following questions if anyone can help:
Will I be able to move to TN visa if I don't get picked in H1B and L1B visa 5 years are about to get exhausted?( If I-140 is approved )
Should I go for TN visa instead of L1B and apply for GC right away ?


I have 3years Diploma in Engineering ( Electronics and Communication ) from India

Would really appreciate your help on this.
 
Stay in L1, or H1-B. if you I-140 is approved, you will stay H1-B until you get GC. Only go to TN if L and H are unavailable.

You will not be eligible for TN since you have a 3 year Diploma (not a 4 year degree) from a non-NAFTA country.
 
A foreign degree would need to be evaluated to be equivalent to a US bachelors degree. One can't make a blanket statement that the degree is not equivalent, since nowhere in the regs is there a year requirement for the degree.

But, as bb00 sez, if it is not even a bachelor's degree, and it is a non-NAFTA diploma, then TN is out of the question.

Hi Goel Sir,

Did you end of doing L1B or H1B ? I am similar situation.
