L1B Restamping - New Rules?

Hi - please advise on this peculiar situation

1. I have an L1B stamped in May 2004 after 10 months of exp in my company (the rule was 6 months experience in the firm at that time)
2. Since then the rule has become 1 year in the offshore operation before you are eligible -
3. I am going to india in Dec - and I was wondering whether I will become subject to this new rule for restamping ? Or will the US experience over the last 19 months count as qualifying me for an L1B ?

The new rule will be applicable if you are going to obtain a new petition. You have to obtain a new petition if your petition has expired or if you r travelling back to a different client than the one mentioned in your current petition.
 
L1A extension and processing time

My husband is on L1A and i am on L2,both our visas got expired the same goes with our I-94...now his company has applied for visa extension some time in August 2005 (he got the application receipt number sometime in sept 1 week)earlier he was working for a different client and since he had applied for an extension he has started to work with another client...kindly tell me how this wud effect the decision on extension??.....and how long does it generally take for USCIS to arrive to a decision on the extension??..as me and my son in India and we waiting to join my hubby.

All ur replies wud be of great help ...thanks a lot!
