L1a soon to Expire and I-140 Pending ADVISE PLEASE

Hi ,

I came to USA in 2003 on a L1-B Visa , we Extended it and shortly Thereafter my Visa was converted to a L1-A which expires Okt 31 2007. I then filed my I-140 petition as well as my I-145(EB1), EAD, and Advaced Parole Docs in March 2007 with my wife's as well. I have received my EAD(Valid for one year) and My advanced parole Docs. My Wife has received her new EAD but not yet her Advanced Parole Docs. However my question is....

My L1-a Visa expires in OKT and chances are I am probably not going to have my I-140 approved by then. What are my options ? Has anyone been in this situation ?

Any Suggestions and or Advise ?

Did you receive any response to this? I am almost in the same boat and would like to know what are my options.

I am told L1 holders dont enjoy the same benefits as a H1 holder with respect to extensions after I-140 is cleared. Not able to confirm it anywhere though.

Since you came to the United States first in L-1 visa in 2003 and now you are in L-1A status, you should be able to extend your L-1A status until 2010. Or, because you already have an EAD and an Advance Parole, you can just ignore maintaining (and effectively give up on) your non-immigrant status. I suggest that you retain your L-1A status until its 7-year stay limit comes, so that you can revert to L-1A just in case something happens to your I-140 or I-485.
