L1 to L2 conversion while in USA

Hello,

I am in US on L1-B visa from company A. My wife is also in US on L1 visa from comany B.

Can she get her L1 visa converted to L2 visa here in US only. Please let me know -

1. What is procedure?
2. Do my wife has to resign from her company?
3. How much time it takes?
4. Does she need to go to India for L2 stamping?

Please reply ASAP.

1. You need to apply for a change of status to L2 by filling in the appropriate form with USCIS and paying the fees. Usually the immigration attorney of a company will handle this dependent visa filing in most mid size to large companies.

2. Not necessarily. Resigning from the company is not required from a USCIS and legal perspective. For example, she might be able to get an unpaid leave of absence if she intends to go back to the same company to work.

3. It takes a few months for the change of status to come through.

4. No. She doesn't need a stamping as long as she stays in the US. If she leaves the US and wants to re-enter the US, then she needs to have the L2 stamp in the passport. At that time, documents showing the relationship to L1 visa holder such as marriage certificate, marriage pics, copy of L1 petition will be required in addition to the usual visa forms and fees.
