L1 to H1

Hi,

I am currently working in US in L1 visa. I would like to change my job and get a H1 visa from a employer. For getting the H1, the employer would file the application in April 2006. I need guidance for the following issues.

1) Suppose, if i get a job before April 2006 and the employer files for the H1 and due to some reasons the H1 approval is getting delayed, is there a possiblity that the employer may withdraw his offer due to the delay. Is the employer bound to give the job even if the H1 is approved after a delay.

I am asking this because if i get the H1, i cannot continue with my present company (as L1 is no longer valid) and the new company may have wanted the H1 much earlier.

It's all up to your H1 employer.

BTW, your status will be changed after Oct 1(if this is your 1st H1) and, until then, you can not work for H1 employer.
