L1 to H1 query

Hi,

I am working for Company A and deputed in US on L1B visa. I have an offer from company B who has

filed H1B Consulate petition this year and recived approval notice I-797B. As the H1B petiion filed

is consulate petition, I need to tarvel to India to get it stamped in Chennai to activate the same.

Could you please advise me which of the following options is recommended to move to company B?

1.I quit Company A in Sep,travel to India,get H1B stamped in Oct and join company B.
The only issue with this is in case of any issues with H1B stamping, I cannot return to US to wind up my belongings in US.

2. I stay with Company A, go to India for vacation in Oct and apply for H1B stamping for Company B. In this case do they invalidate the L1B visa stamp while issuing H1B visa?

If yes then as H1B visa is for company B, can I come back to US and give resignation notice of few days to Company A (and work as well during the last few days with Company A to transition my work and get a clean resignation) and finally join Company B in second fortnight of Oct?


I am really confused as to which option is feasible and best. Appreciate your quick response.

Both works, but L1 visa is more likely cancelled when you get H1 at the US consulate.
Strictly, you should not be an A's employee when you enter the US on H1, but may be fine if you go straight to A to quit and join B.
