I am a new member and currently on L1B(got it on 12/11/2002). My L1 approval notice/visa max outs on 12/11/2007.My company procesed my L1 to H1 conversion in the begining of 2007 and my H1 was not approved initially saying that i have to send some RFE documents for further proof.Due to some miscommunication btwn my company and myself, i was told that my vacation to India wont affect the L1-H1 conversion and hence I was in India when they filed my case.After sending my passport/I-94 copy and some other docs from company my H1 got approved (i am yet to get the papers).
But when i checked my daughter's EAC online, H4 didnt come through .he case was still showing waiting for RFE.When i contacted my company they said I have to go to India before my L1 maxout and do some CONSULAR PROCESSING and get my H1 stamped and then only I can get my daughter's H4.
I have few questions regarding this.
My L1B approval notice/Visa is expiring on 12/11/2007.These are my travel details to/from US.
WHEN HOW LONG
12/20/2002 - 02/16/2002 2 months
05/30/2003 - 02/13/2005 1 year 9 months
03/05/2005 - 03/23/2007 2 years
05/06/2007 - Will be here till 8 months

1) Would I be able to recaputre the period during which I stayed in India on vacation/pay roll. If so how long can I stay in my current L1B?
2)Should I need to apply for my L1B extension as my approval notice/visa expires on 12/11/2007.
3) Is this extension like the normal L1B extension process or will I need to provide extra documents as a proof of my stay in India(out of US) for the above mentioned period.I dont have any kind of prove other than entry and exist stamp on my passport.
4) If I need to apply for L1B , can I initiate the process now itself.When will I be getting new L1B extended approval notice.
Since I just now came back from my India trip I am still debating of going back to India for H1 stamping. If I know that I can stay in my L1 till april 2008 then I can go sometime next year to India for the stamping.
If I cant go beyond my approval notice date which is 12/11/2007 then I would have to plan my trip before that.
It would be really really a great help if anyone could answer my questions.
