L1 to H1-B visa -Re-enter US

Hi,

I have a query on visa transfer from L1 to H1B..currently, i am working here in US on L1 visa.my H1B is about to get approved from some other employer. My H1B was applied in May 2006 when i was not in US.and My L1 was applied and stamped in August 2006.
so once my H1B is approved,if i want to goto countires outside US for few months ,can i come back on L1 itself(being employee of present company itself).
ie;can i extend the stamping of my H1B to a later date,even if its approved now.. Or is it that i have to make sure my passport is stamped with H1B ,when i exit and come back to US.Alternately, if i want to continue with present employer, can i get my H1B cancelled.

Any help/thoughts on this is highly appreciated.

As your H1 was filed when you were out of US it seems that your H1 approval will not be having I-94 attached. If you want to enter US on H1 status you will need to get H1 Visa stamp in the passport and then enter on H1 status. For more info you can talk to your lawyer with your all the details
