L1 to F1 -Urgent

Hi,

My L1 Visa is expiring on 8th of June. My extension request for L1 has got into additional evidence request from the USCIS. I already have I-20 from a US BSchool. Can I go ahead and apply for the COS from L1 to F1. I can not fly back to India because my Kid is born 2 days back and it will take 6-8 weeks for his passport(US)and visa for India to come. Apart from that such long duration flight will be too taxing for him.

My school is starting from 25th July.

Please advise asap.

Its creates a lot of complications having 2 amendments pending for the same petition. You should probably withdraw the L1 extension and at the same time file for COS to F1. No guarantee that it will be granted, so you might end up having to get the visa stamp after all.
