L1 dependent quiery..Urgent

Hi everyone

I am getting my L1 to H1 done this year and will get it approved in Oct 2006....my question is

1. Will the H1 get in effect as soon as it is approved though i continue working with my L1 sponsored company?

2. My wife is travelling to india on medical emergency and will be returning in dec ...i have already applied for her L2 .....in that case once my H1 is approved will she still be eligible to get L2 stamped(as i will still be working for my L1 sponsor) or do i have to apply for H4?

1. Your H1 gets valid only after H1 start date stated on H1 approval(petition).
2. If yourstatus got changed to H1, your spouse must be on H4, not L2.

Thank you for your response ...PR..

In that case how can i change my start date as we have already applied for her L2 and she is getting her stamping date in india in december.

As right now i am not on H1 that is the only visa i could apply for her.

Please help
