L1-B to L1-A and now to H1 - Is it possible to use AC21

Hello!
I'm currently on a L1A. Earlier came to US on B1 and L1B. Going through a few posts, I saw that a H1B - L1 - H1B change of status / transfer doesnot need to be under cap as this person is not valid for new 6 year term.

In my case as I've spent 3years in the L1 status [both A and B together], can a prospective employer apply for a L1A - H1B transfer, so that I can start working ASAP, rather than wait for approval under the 2006 quota?

Kindly advise if AC21 applies to my case as I will not be eligible [technically] for a full 6year H1?

Sorry, AC21 does not work for your benefit. You need to have been in H1b status before. Going from L1 to H1b you need to wait till the actual approval before you can start working.
 
Hi Sai,
I want to understand the process for conversion of L1B to L1A...I have L1B which is expiring in Feb 2008. I have been working as Project Manager for last 2 years (became Project Manager while I was in USA) hence wanted to know if I am eligible and any preconditions which I need to be aware of...just wanted to understand your perspective and experience...Thanks in advance !
