Hi,

I will explain my problem as below.

1. Visa Type: L1-B (Blanket)
2. Visa Expiration date : 22nd June 2009
3. I-94 expiration Date : 22nd June 2009
4. My wife is pregnant and the due date is on 12th Sep 2009. she is in her 6th month now.

My employer had applied for my visa extension on 8th April 2009 by filing I-
129 with USCIS and the same was received by USCIS on 22nd April 2009.
My employer had sent me the application reciept number.
Currenlty the status of my application shows that the case is received and pending.

Questions :

1. How long will the USCIS take to respond once they recieve the application for L1 B extension. My application was received on 22nd April 2009 by USCIS.

2. How long can I stay if my visa extension gets rejected/denied from USCIS BEFORE my visa expiration date ( 22nd June 2009 ). Can i stay till 22nd June 2009 if i get to know about the rejection before?

3. How long can I stay if my visa extension gets rejected/denied from USCIS AFTER my visa expiration date ( 22nd June 2009 ). Do i need to leave with in 24 hours of the rejection notice or with in 30 days. Is this time limit based on the i-94 expiration date or based on the rejection notice issued.

4. My wife will be in thrid trimester (8th month) in the month of july and if i happened to know about my visa rejection in the month of July. Can we appeal on this with USCIS about the pregnancy and can extend our stay in US.

Please advice

She is a dependent of an L-1 status holder. I very much doubt her pregnancy would be a variable as far extending your stay is concerned. Having said that, you both may apply for COS to B-2 status.
