L1-A Visa with GC application

My L1 visa expires in october and my company has put in an application for a green card.
What is the normal time span from application to recieving a GC?
Is it likely that I will get a GC?
My company seems to think that I can stay on after the visa expires so long as a GC application has been put forward. Is this correct?
Thanks.

The process can take anywhere from 1 to 2 years or more depending on the availability of visa numbers (= Greencard numbers for your category). Since you applied as an L1a you probably didn't have to do a labor certification. The steps you will go through are I-140 (immigrant petition for alien worker) and I-485 (register permanent residence). The first is the actual application for a greencard and the second will take care of your change of status to a Permanent Resident. Just do a search for these two form names and "government processing times" or check the USCIS web site for the current expected time line. Because of back log situations it is expected that much less visa numbers will be available in the near future so that might affect the total processing times.
While your application is pending you can stay and work for the sponsoring company. When you want to travel abroad you need to apply for Advance Parole to be able to return to the US. Please check with your attorney for details.

L1-A to GC

Hi robT,

How many years you stay with your company under L1-A? Did your lawyer confirm with you that you can skip the LC when applying GC?

I'm currently under L1-A and my lawyer told me that I need to comply with the requirment of "working in an oversea organization for 1 full year out of the 3 years before my GC petition, not before the date I get my L1-A visa" in order to go for EB1-C and skip LC process. I'm confused.

billy__bob, can you also give me some advice on this? Thanks.
