L1-A...Need info/clarification...pls advise

Hello everyone,

I'm in the US on L1-A visa for 2.5 years. I have the following questions:

1. My I-94 expires on April 7th 2007. How soon can I apply for extention? Can
it be done online? Should I do or only my employer?

2. I heard that L1-A visa holders don't need Labor approval for obtaining
green card and they also fall under EB-1 category. If I have a potential
employer in US (NOT MY PRESENT L1-A EMPLOYER), by any chance can
they apply for I-140 and process my Green card?

Hi,

For your L1A to be extended it is better if your employers does it especially if it is a blanket L1A.
There is a lot of info the USCIS will need even for your extension about the company.
eg .
Petitioner Company's Information:

Articles of organization for foreign and U.S. company affiliates
Company brochures with description and addresses
Number of employees of parent company and affiliate
Financial Statements of both U.S. and foreign affiliates
Documentation showing evidence of connection between the affiliates

Letter of Support from Employer
Alien's title, and detailed job description with any special skills relevant to the position
Salary and benefits offered
Name and title of person who will be signing petition


and about your 2nd question. People mistake the fact that because they are on an L1A they do not need a labour
Well that can be the case IF you apply you I140 under EB1, L1A and EB1 are not really linked, however saying that you are more that likly to fall under EB1 if you fall under L1A - but remember the conditions are much stricter to meet the criteria for EB1 than L1A - your employer will have to petition you under the i140 and prove that your role is indeed in the catagory EB1.
But like you said once your fall ubder EB1 you need no labour.
