Kept one year H4 illegal experience in Resume- Will i get rejected for H1 transfer?

Hello,

Can some one helpe me out !!!. Here is the problem

Well i came to USA on H4 on July 2003. I got my first H1 on oct 2004 filed by some "X" Company. Now i got Full time job with company "Y".

I worked at my brother's company when i was on H4 between Aug2003 and July 2004, and i added this one year experience in my Resume along with H1 valid experience. I sent this resume to company "Y" and i got selected in the interview. They are willing to do my H1 transfer.

Iam worried that my H1 transfer will get rejected as i showed experience which i got on H4 visa in my Resume. Will INS really go through each and every project Dates and see on which status i was when i was doing the project ? I am not allowed to take off the experience off my h4 experience with Y company. :confused:

Since you are aware of this, you should notify the lawyers of the new company ("Y") before they prepare your H1 transfer paperwork.
Lawyers should be prepared in case something comes up and they won't like it if they find out about this on their own somehow.

Plus you will definitely have trouble if you want to apply for a GC later in life.

Did you receive money by pay check?

If it is just resume you mentioned is matter, you can tell company lawyer to remove those years experience. usually your resume did not go toI NS as such, attorney will fill up work exp portion in date wise in the h1 application form. if you take care of this issue it will not give any trouble while going to GC, but once you register in application it is going to be INS record and can be verified at any time and at any stage at any service center.

Similar Case--Urgent Help...!!!!

Hi guys....

I have a similar case with my wife...while filing the H1B petition she mentioned that she is working with company X in Bahrain (Middle east).
But she her bahrain visa says "Cannot take employment".

Now my question is ....

On record she is on a housewife visa...but the rules here are not stringent.

Now does the embassy here in bahrain has access to the form filled specially the work exp part so that she can check if she was working here? When she went to the consulate she mentioned at present as housewife...and did not mention the details of the this Company X ....Will this be a problem for her getting the visa???

Urgent help required...
 
Well, the authority in Bahrain will want to talk to you for breaking the law. By the way I am sure you have heard of Ali at the Ministry of Labor.

Anyway see if you can get the US visa and get away with it. Best of luck!
