The USCIS Service Centers frequently issue Requests for Evidence (RFEs) for supporting documentation to establish that a person has been maintaining valid legal status in the United States. Frequently requested as evidence are copies of pay stubs covering a certain span of time. This request arises in various types of cases, such as when approving an H1B extension with a change of employer, or when approving an I-485 case for an applicant. For this reason, we remind MurthyDotCom and MurthyBulletin readers to keep all their pay stubs, tax returns and all attachments in a safe place, should they are ever needed.

There are numerous reasons a request for pay stubs can arise in an employment-based I-485, Application to Adjust Status to Permanent Resident, case. They may be necessary to determine whether the applicant has been working for the sponsoring employer. They also can establish whether the applicant has been working regularly and, therefore, is less likely to become a public charge. A third reason is to discern whether the sponsoring employer is paying the applicant the required prevailing wage. For I-485 purposes, the sponsoring employer is not required to pay the prevailing wage until the I-485 application is approved, though the good faith of the parties is better served if the prevailing wage is paid before I-485 approval. Though these are the primary reasons, there may be other factors that prompt the Service Centers to decide to request pay stubs.

The USCIS Service Centers may also request pay stubs at the I-140, Petition for Alien Worker, stage in an employment-based case as part of the determination as to whether the sponsoring employer has the ability to pay the beneficiary the required prevailing wage. Some of our readers may have heard of requests for pay stubs associated with an H1B or L-1 extension of status or with a change from one employment-based nonimmigrant category to another. Typically, a number of pay stubs are submitted with these petitions when they are filed, but the Service Centers do request additional pay stubs in a small percentage of cases.

The numbers of pay stubs requested vary. In some cases, only the three most recent pay stubs are required. However, we also have heard of RFEs calling for pay stubs covering anywhere from a three-month period all the way up to a three-year period! Therefore, we suggest that MurthyDotCom and MurthyBulletin readers always keep their pay stubs from their employment in the United States. You never know when the USCIS may ask to see them and it is always better to be safe than sorry."

I agree, they could directly check with IRS/SSA without ever asking the applicant (just like SSA has access to our EADs).
Anyway, if USCIS can send an RFE for I140 copy for 2nd AP renewal, you can never expect anything logical.
In the meantime, do save your paystubs.
 
Why can't they check credit

This is absolutely ridiculous. I know lot of people do fraud and BCIS wants to get rid of them. But for genuine people it is too much to ask for. How can they expect me to save 3 years of my paychecks ?
Either they should try to process GC in 6 months, then every one can show their paychecks OR they can do credit cheks for that. I applied for apartment couple of years ago in Denver and the manager showed me my credit report (he is not supposed to show me. I should request a report from the agency). I was surprised to see the report. They can tell how much you made and what was the highest balance in the account etc. why can't they do the same ??? Or request information from IRS ????
 
I used to think Murthy is smarter than this. But, then she is a lawyer - Her survival is dependent on the "scared" clients.

What ever your employer sends you in mail for the payment you received for every pay period. (If you have a direct deposit where your employer deposits money directly into the bank , then you probably get a document with a void check and details abou the taxes deducted and taxes deducted year to date and Social security taxes and state taxes etc. Otherwise (No direct deposit)you will get a document with a check which can be detached for deposit).

Recently I met with a person who was working in US for one of the top 5 in India. These companies does not provide the Pay stubs so the employee cannot apply for H1 transfer. This fellow desperately wanted to apply for the H1 transfer and did not have the pay stubs. His attorney asked to him provide him an affidavit stating that he is H1 employee and company does not proved him the pay stubs and mentioning salary for each month during last year.
He got H1 transfer
 
I wish those guys really got payment if not paystub. :p . What can make top 5 company do that way.

Let me guess, that must be TCS. This is how these blood sucking body shoppers become top five in India. :eek:

I have personal experience with her--her tactics is to scare people to make more money.

I wouldnot trust what she says for filing ead she wants 250 that to she increased it by 100% in a years time
 
My employer recently stopped issuing pay stubs for people with direct deposit. But they are availabe electronically...I'll starting printing them and saving a copy for myself.

Same here. Do we work for the same company? ;)
 
Lot of companies do provide electronic paystub. ADP has a option that employers can choose.
I don't believe Murthy is trying to scare. I have seen atleast one who had a RFE to provide last 3 month paystub.
It is always a best practice to keep one year's paystubs to cross check(if needed) when you receive W2.
