KCC sent me apointment letter with my child as benfbut not my husband

Hello folks: i just have a few questions about how to procced in the interview, I have applied as divorced, i have to children of 13 years old and other of 3 i filled DS230 for them and sent it to KCC no i have the interview scheduled for dec 21 and the older guy does not want to go to USA now.
Any idea about what to do? is there any posibility to get the gc since i have already filled his DS230 and he is listed as beneficiarie. can i tell the CO that he decided to stay and dont want his GC? and the other question is i applied as divorced and get married again, i sent the new papers but KCC did not update my info and put only my childrens as benef. i called the local consulate and they did not answer me or even sent me an e;mail.any adie in how to proceed.

I would suggest you get as much evidence as you can to show that your marriage is for real. I suspect you will be questioned about the timing and validity of your marriage. The case is out of KCC's hands now so you must contact the local consulate for instructions with regards to your husband's case. If all else fails walk with your husband, his completed 230 forms, your official marriage certificate and his visa fee on the day of your interview and be prepared to present your case. Your son does not have to go with you now, at your interview just let the officer know that he will not be migrating at this time.
 
Hi thanks for your comments, i will explain my case, i have 2 children the older one if from my fist marriage, she is a girl and she wants to stay in our home country until she finished her high school tha is 4 years ahead. i divorced her fater and met my actual husband we marriage in oct 2010 but we live together since 2002 an we have other children , he is 3 and we are planning to travel together, is a children a proof that my marriage is for real? and the othe question is can my doughter get the gc if she planning to travel to join me 4 years ahead,sorry but im knew and all is new for me.

I'm just reading this so I couldn't answer before.

Having a child together will surely help you prove that you had a relationship with your husband before actually geting married. Some evidence that they may consider relevant are joint bank accounts, joint mortgage/lease agreement, proof that you both were living together for a while before winning the lottery (bills/correspondence with the same address) and photos of family events, vacations, graduations etc. You should be able to answer questions about his family and he yours. Having a 3 year old child surely strengthens your case but I like to over prepare..lol

Your older child can get the GC now with you BUT she must migrate with you and not remain out of the US for any extended time or she risks losing the GC. If she does not want the GC now then in 3 years time you can file for her(once she is under 21) so by the time 4 years has passed she should be getting her papers to migrate. This is a simplistic take on the situation, I'm sure more experienced folks could add their advice. The perfectionist in me would advise you to get her GC now, this is a rare opportunity to get things done fairly easily/quickly the first time. Get the GCs, migrate as a family and you all can come up with a workable solution afterwards.
 
I agree with sonibago about your older child getting the GC now. It'd be alot easier to have her processed along with you and obtain the GC and SSN now, than you having to petition for her much later.

I would suggest, that you continue to have her processed along with you. Then she can travel with you to the US to have her GC and SSN activated, and then she can leave for you home country after those are secured. In my case it took 2 weeks, plus I had already left the country before they arrived for me to personally receive them. What matters though, is that I'd done all the initial stuff to activate it and my wife received them - oddly enough when she got back from dropping me at the airport for my flight out !!

With those secured, then I'd recommend she travel at least once every 12 months to the US so that she can keep her residency status. With her GC and SSN she'll have other opportunities worth exploring once she's done with high school. College (university) in the US would be an option, and she'd be eligible for grants and school loans just like any other legal permanent resident and US citizen. There's just more options available, is all I'm saying, if she has it done now, and she has nothing to lose by just going along with it.

I agree with some that is written before...but one important issue is forgotten. If your oldest doesn't want to move, that is fine...no issue there.

If the oldest wants the GC and doesn't stay in the country for long periods, the child will lose the GC anyway...so why bother.

Also the father of the oldest has to give written permission for him/her to immigrate with you. The US doesn't want to be liable for children to be taken abroad with the consent of the father and/or mother, depending on the situation.

The youngest child is similar....You didn't enter your husband into the lottery....red flag! Why didn't you enter him....perhaps you weren't married at the time, but at the time you filled out the paperwork you were married and still didn't incl. him...so they will look at it more closely.

If he can't get the GC they might wonder if they will give the child a GC...it is all in the hands of USCIS or your consulate.

hi bentlebee, thanks for your comments, when a aplied for edv, my status was divorced, im divorced from 2001, after that i met my actual husband, we live together since 2002, after win i sent the forms to kcc that was in jun of 2010, and i got married in oct 2010, that is way i did not included him in my papers, now i have contact with consulate and they request me to send marriage certf ds 230 of my husband and a copy of his passport.
Any idea why? they told me that the consul will review if he meet requirements to be included in my case.
hope to hear any comments of similar experiencs
 
tarmac727 the consulate are just requesting the info so that your husband can be added to your case. You should start organizing documents, photos, bank statements, lease/mortgage statements that prove that you and your husband has been in a relationship long before the DV win, of course having a child together helps. By the way, I was just wondering what have you decided to do about getting the GC for your older child?

1. For your eDV, did you include correct info for BOTH your kids and said you are divorced ?
2. Do you have the basic high school and or work qualifications. (work qualification alone is v tough to get a DV)

Then, as for your hubby the request from embassy seems routine, to include him in your case.
as for him (and your case success) following are v important;

1. Your younger kid is his best help, do you have her birth certificate issued 3 yrs ago clearly mentioning him as father?
2. Do you have the divorced certificate issue long time back?
3. Do you have 'documents' from the past which can prove your relationship like bank a/c, loans or similar 'legal' documents with both your names?

If so, you'll get it easily but prepare for the worst (at intvw) but expect the best!

For your elder kid, grt if she can get it now and go with you but its her call.
Later on after 5 yrs or so you will be able to get it for her but as you know future is uncertain so try get the best from the present.
(Even with your GC status you can sponsor her under GC-F2A category within 1st 5 yrs, the wait time now is greatly reduced but it can get backlogged pretty soon I m sure. Family based GC in any case is a cumbersome process best handle with help from a good lawyer)

Yes, when i filled e Dv i did as divorced and i complete the info from my 2 children,
yes i have high school diploma and actually working.
I have birth certificate from my younger kid with his father name who is my husband
i have divorce certif frm long time ago (2001)
and as proof of relationship we are living togetger from 2002 and i have a certificat that states that wich was done to added him in our medical service.

My older child does not want to leave our country now so she is planning that may be in 4 years so i could not do anything to convince her to leave.

our consulate is in Argentina South america and interview date is dec 21st so i will post our experience in this case

1. it is a must that you and every beneficiary must appear for the interview.

2. my sister was in ur child shoes 6 yrs ago but she took her transcript and went to finish high sch in us and 2day she is in her 5th n final years in d university.

3. you should be able 2 prove to the consular officer you actualy married and you wil be gud 2 go
 
you will need a custody permit fron your ex for you fist child. A GC holder cant stay outside the states for more than 6 months. i wish you gudluck as you make your final decisions.

Hello Wendogg, thats true , our interview was on 21st at Bs As Consulate, the experience was really great, me and my family were 15 min before 2 pm in the afternoon, first step security, all liquids not allowed, after that we proceed with the finger prints and waiting to be called, i was called to presente all documents required and told me to wait to be called again with my family, after almost 2 hour they call we, we proceed with the interview, question like, were we would like to go, if we have family in the Sates, money that we have to support our first stay,why we get married just before the interview, but we already have a child since 2008 so that was more than a proof of our marriage,wich state we would ike to go, when we would like to go but nothing rude , very very nice woman as CO, after 15 min of interview all my family got the GC, thanks to god our dream comes true, also we would like to say thanks to all of you for your comments and support about our case and also wish all the luck in your cases and wishes .

Hi everyone, as stated before, we got our GC on dec 21 2010 but my older doughter did not want to travel with us at that time, but now, she is a teen and change her mind, she want to receive the GC too so we are dealing we the consulate to see if is there any visa available for her, does anyone have experience in similar cases like this? how often they know about availability? the consulate have to chck it with the NVC or how does it work, any comment please , do we have any possibility for her?

oh wow tarmac727, that was a quick change of mind for your older daughter. Even though I believe they may tell you that your case is closed, I really really hope the consulate can do something for her.

yes she changed her mind probably late , but the consulate sent me an email stating that if between jan-sep 2011 is there availability of visas, she could get her GC but you never know, our case were current in dec that was when they can gurantee a visa for us, but know we have to wait to see waht happen, that the consecuences of dealing with kids.
i will keep updating info to other similar cases, just in case.
