K3 approved now what is next??

Hello Guys/Girls:

I am USC and have filed I 130 and K3 for my foreign national spouse. She got her K3 visa yesterday (5/5) in her home country and will be travelling to USA later in the month. I am wondering if someone from you know what will be next step for me when she comes to USA at the end of this month.

From what I understand she will file for her Work Permit once she gets here and only after that she can apply for her SSN and driver's licence.

I am wondering if she will be able to file for the I-485, AP and ??? right away or will we need to wait for !-130 approval??

after k3 approval

Married in "feb" 2002 to an USC.

Filed I-130 in "March" 2002 along with I-129f.

K-3 approved in "feb" 2003.

Arrived USA in "April" 2003 on k-3 visa validity for 2 years 2003-2005.

Applied for SSN in "April" 2003 got my SSN number in "april" 2003.

Applied for EAD(Employment authourization document) in the
month of "MAY" 2003 and received the work permit in the month of
"AUGUST" 2003.

Filed I-485 AOS in "AUGUST" 2003(Adjustment of status) obtained receipt

notice in "OCT" 2003 and submitted FINGER PRINTS too.

Iam waiting on for my I-130 and I-485 approval.
I would also like to know
1) What happens after I-130 approval??

2) Do i also need to file the the papers for REMOVAL OF CONDITIONAL

RESIDENCY as our marriage is of more than 2 yr? Our married life is
wonderful.

What happens after my I-130 approved?? do i get the permanent
green card or
the conditional green card?? :confused:

Well, i got a notice on I-485 (which i submitted at local office)
stating that to expediate my case the file has been transferred to
to the service center where the I-130 was filed and also the
notice said that to process the case it takes 30 to 90 days.And
after 90 days when i contacted they said that the file is kept in
BACKLOG and would send the information about the acton taken
in another 3 weeks to 4 weeks so iam waiting on for their reply.

3) Does any one know what BACKLOG means and what would be
next course of action???? :confused:

Hope some one who went through this kind of process or having
experience may kindly post reply.It'd be of gr8 help.

I had a quick question for you. I am a USC and have applied for K3 visa for my spouse on April 19th 2004. As you have indicated that your spouse has already recieved the K3 visa so I was wondering, if you can provide me with the details on the processing time for K3 visa and this way I will have an idea about the processing time for K3. Your response is greatly appreciated.

k-3 approval

Hi janooooo,

k-3 approval time is 3 to 6months when it is approved the service
center sends the package to the consulate where you performed marriage and in turn the consulate will ask the spouse to attend for the interview along
with all the documents such as: marriage certificate,date of birth certificate,
affidavit of support( the usc spouce has to send I-864 this form is affidavit of support) if its a second marriage then your legal divorce copy. Ofcourse
the consulate will ask your spouse what documents has to be brought for the
interview, if they dont inform plzz take all these documents original.
The consulate officer will ask your spouse many questions such as how did you met your husband? is any of your family member live in US? and so on.
Hey one thing you must remember before the interview they take the oath
and tell your spouse to talk 100% truth that would help your spouse for the speedy process of GC.BTW the consulate will ask to undergo MEDICALS too
with their authorised doctors only.Once the medicals and the authenticity
of the marriage is confirmed they usually stamp the visa for 2 years and she can join you. On arrival your spouse must fill the I-94 form in the flight b4 she lands in US ooops i've forgottent to inform you that the consulate hands over a sealed package to your spouse and when your spouse lands here (U.S.) she has to hand it over at the port of entry and the officer will take your spouse finger prints.
Well, the next step is go immediately to the SOCIAL SECURITY OFFICE without delaying a single day and apply for the SS CARD
it usually take a month, then with that apply for the driving license,coz without SS CARD they r not gonna issue the license.Also apply I-765 form
employment authorization document,and also have to apply for AOS
I-485 & I-130 concurrantly thats all you have to do and wait on for approvals.


Hey u send ur affidavit of support I-864 in original to ur spouse plus
ur taxes stuff.

hope this would help you if any further question plzz dont hesitate to ask me as i too understand the situation coz i went through the same phase once.

Moving to Chicago with British Husband

Hello,
I have petioned for my husband to recieve the IR1 visa, with the American Embassy in LOndon. We are in our final stages and are waiting for the interview and the embassy. However, we are due to be opening offices for our company by January 2005 and have plans to renew our vows in the USA during that time as well. It is looking like the interview will not be until the end of January. We are considering scraping this London IR1 process and going for a K-3 visa and restarting the IR1 process while living in the states because my husband is worried he will be denied entry into the USA before he holds his interview in London.
Do you have any advice on this?
