K1 - meeting in the last 2 years but divorces not finalized.

Every case is different and mine is a little complicated I guess. The person I plan to marry and I were together many many years ago, we met again and realized that we married the wrong people, so we are going though our own divorces in order to be together.

My question is when I sponsor her for the K1 and I show pictures of us together, what if some of those pictures were taken before we were were legally divorced? And we have proof of boarding passes, visas etc while we were still married? Or is that a moral issue and US immigration doesn't care, just as long as our relationship is genuine and the K! application is filed after the divorces are finalized?

Just so long as you have met within the 2 years prior to the K1 filing AND your divorce is finalized with your divorce decree in hand then you should be fine.
The 'moral' issue wont be a problem.
 
Only criteria is that both parties are free and willing to marry each other. A lot of people think that means the couple needs to be in love and try their best to ptove it. That is not a requirement :)

Children US citizens. parents on EAD

A friend needs some advice.

Kids are US citizens. As per US laws kids would go to the mother. However parents are on EAD, married by India. So where would the divorce be filed? India or US?

If divorce is filed in India, who would the kids go to? Remember they are US citizens. Mother is very firm that she wants both her kids.

Please See: Its not the mother's or father's choice to divorce, but the wife's Mother-In-Laws :D. Husband's resisting this, and also lying to his wife that its his decision, but she has seen some emails by which she knows whose goofy idea this is! However, the dear wife just decided she has had enough of her MIL's antics and she is ready to give the divorce, if it comes to that but will fight tooth and nail for her charming kiddos.
 
Do the meetings have to be in the fiance's country of residence?

By the way, does the meeting in the past 2 years requirement state that they have to be in the sponsored person's home country or can we meet in another country for vacations and provide those photos?
 
You could meet on the moon for all USCIS care......just so long as you have physically met and can prove that you have done so in the last 2 years (photos wont help with his requirement.....you need dated boarding passes/passport stamps etc) then thats all that they care about.
 
But who would the kids goto? They are US citizens. The couple are happy again, but wifey wants to be prepared. she just doesnt want to take any chances.
 
Top
