Hello,

I had a question and didn't know which forum to put this question. So i am putting this here.

I finished my US citizenship interview on Jan 5th 2010. I have been a green-card holder since 2004 and was on H1B visa since 2000

I have been dating this women in INDIA since Dec 2009.

Our correspondence has been through telephone, e-mails and video conferencing and it is love at first sight – chat – telephonic conversation

But during this time she is spending to wait for her K3 or K1 visa, can see come and see America as a visitors. This girl has lot of friends here in the US and also her cousin is in the US and she has not meet them in a long time and want to stay with her cousin.

Girl's parents are in India and they have property there and the girl is planning to take a leave of absence from work.

Please let me know the steps i need to take so that our situation is not misrepresented at the immigration.

Thanks

Just having a k3/k1 visa in the works does not exclude someone from entering the US- infact, many people have successfully entered while having their K1 or K3 pending. However, this does open up greater scrutiny and increases the chance of a potential denial.....just make sure your spouse/fiance has plenty of proofs on her person to show that she intends to return back to her home country by the end of her 6 month entry, and that she wont attempt to AOS while on the visit. The best thing to do though is to mentally prepare for a denied entry....that way if she does get denied, you wont be too shocked, but if she does make it through, then you have something to celebrate.
