K-3 Visa along with i130 application

Hi All,

I am a green card holder right now and will be getting married in june 2011. I want to bring my wife here (she is an indian citizen). I am going to apply for my citizenship in July 2011. I am planning to file her i130 for GC application for her before I apply for my citizenship (means right after I get married). I am hoping that I will get my citizernship in 3-4 months and then I can upgrade her application from F2A to IR so it will speed up the process and she might get her visa in 6-7 months after I get citizenship.

so If I want to bring her much faster, is it fine to apply for K-3 visa once I am a citizen eventhough I have started her i130 application right after my marriage?. or does my i130 application be cancelled when i apply for K-3 visa. Is K-3 visa tough to get or Is it gud to wait until she gets her GC and then bring her...

Filing the I-129F for a K-3 is free and available but would likely be useless. Once you naturalize, then you can upgrade to IR and file the I-129F, since the I-130 could already be approved by the time you upgrade, any K-3 would be cancelled out in favor of the CR-1 immigrant visa. The K-3 is becoming obsolete in the grand scheme of things.

So do you think in 3 months time my i130 application for my wife will be approved even though I filed when i am a GC holder? I heard that if I file as a GC holder, then there is a big delay of 3-4 yrs before it gets approved..(but I heard now that its not that big delay..people are getting it in less than an year..i might be wrong..i dont know).

so As you mentioned, if the i130 already got approved, by the time I get citizenship, then K-3 will be automatically cancelled, since i-130 is approved right?.

Once an LPR I-130 petitioner (you) naturalizes, you send a copy of the signed naturalization certificate along with either the I-130 receipt notice or approval notice to wherever the file is located. It could still be pending at a USCIS Service Center or it could have been approved and shipped to NVC at the time you naturalize. Wherever it is and whoever has hold of it, you tell them that YOUR status has changed and the I-130 must be changed over to the Immediate Relative (IR) category and faster processing.

The Department of State has posted its policy on its website of quashing a K-3 in favor of an Immigrant Visa (CR-1 or IR-1). Look to their website and search for that information. Only a very few posts will still bother to issue a K-3 anymore.
