My Fiancée was approved for her K-1 visa in May 2010. At the time we applied for the K-1 visa she was pregnant so we were not able to add the child's name to the I-129F for K-2 visa derivative. The baby was born in June 2010. The baby is not mine in a biological sense and I knew this at the beginning because I am not able to have kids of my own, but I still want kids.
My Fiancée visa will expire in November 2010 and we have had to make arrangements for her to travel here without the baby unfortunately because she has no K-2 status or visa. My Fiancée family will keep an eye on the baby until we can have her approval.
What is the fastest way for the baby to join us here in the US? Do I need to file seperate paperwork? Does My Fiancée need to apply for the baby to join us after we marry and she submits her adjustment of status? Can the K-2 be issued at this time?
