K-1 I-129F Petitioner

Hey guys, my name is Leslie and I was going to try and get some input from everybody to add to my storage of stuff I already know. I want to know if there is anything I might be missing from my Petition package. Also I wanted to see what sorts of things you guys have used for evidence to back up your k-1 visas.

I met my fiancé Michael in September of 2008 on an e-pal site. I wanted to talk with somebody who was familiar with Ireland because I had developed a sudden interest. We went into being friends without know we were going to form a relationship, but it did form and very quickly. We’ve spent the past ‘almost’ two years talking through e-mails, MSN messenger, and then about a year and a half ago, on the phone. We eventually met for the first time in person on August 21st of this year and we had a two week long visit. We established long ago that we wanted to get married and have a family, but we could actually go about doing it until now. Having him leave me was one of the most heartbreaking and sad days of my life aside from tragically losing my older brother in a car accident. Anyways, we decided that he would come over here to live for now, if not permanently, and that we needed to get the ball on the roll.

So far I have filled out the following forms-

-I-129F Petition Form
-G-325A Form
-I-134 (from both myself and my father and I’ll have one form his parents as well)

I also have/will have the following letters:

- 1 Cover letter for my petition
- 2 Letters of intent (one from me and one from Michael)
- 1 Letter of how we met (for question 18 of the I-129F petition)
- 1 Letter of the history of our relationship and future intent
- 1 Letter in regards to the photographic evidence

So far for evidence I have the following:

- 10 photographs of myself and Michael (all dated with locations listed and persons in pictures)
- Phone records for the last six months (I had a phone number change six months ago so I am going to try and acquire at least six months more if possible)
- Copies of Michael’s travel tickets and his passport
- Copies of Michael’s ESTA approval of entry for his trip

For evidence of a legitimate relationship I will have:

- Phone records
- E-mails
- Letters sent between Michael and myself

I know I’ll still need the following:

- I money order for $455.00
- Copies of mine and Michael’s birth certificates
- Declaration of how we met within the past two years
- 1 Passport type photo of myself and one of Michael
- 1 G-325A form from Michael


Neither of us have been married before and neither of us have children. So we don’t need proof and legal termination of marriage or anything like that. However I’m curious to see if I need anything else or if anything else might be helpful for our case.

Another question, and I know it varies, but about how long does it take for the Petition and Vise to go through. I know you guys can’t get me a definite answer, but any sort of input would be appreciated. I know the USCIS says five months each for both, but I heard it can go slower or fasted depending on who gets the case. Also I wanted to know if you guys might share some of your stories with me, good and bad, so I can see what I should expect.

Sounds like youre pretty organized and have prepared thoroughly.

Just make sure that both you and your fiance have filled out and completed a G-325a form.

Also, the I-134 is not needed at the petition stage and should not be sent off with your packet. Instead, your fiance will personally present it to the consular officer at the embassy/consulate (along with its supporting documents such a tax returns/transcripts, letter from your employer stating your salary etc) when it is his interview.
 
Thanks both of you for your replies! Means a whole bunch to me! I will make sure that I don't send in the -134 forms with my packet, thanks for the heads up. Also, my fiance can't go to Dublin to the consulate because he lives in Northern Ireland which would make him a British citizen. Do you think that will make things more difficult or do you think that he will have to do go Dublin anyways. He thinks his closest consulate would be in Belfast if I'm not mistaken. Again thanks for your input guys.

On another note, I was wondering about the I-134 form. I haven't had a job since 2008 and I live with my parents currently. I help take care of my mom because she has health issues. I read that even though I don't have a job I still have to fill out the I-134 and that whomever is going to be the joint supporter will need to fill one out too. My dad has agreed to support him until he can get on his own feet over here in the US and he's filled out an I-134 form, but I'm wondering....since I don't have a job do you think our case will be rejected?

If he lives in NI, then his K-1 will be processed in London. The US consulate in Belfast does not handle K-1 visas.

Also, my fiance can't go to Dublin to the consulate because he lives in Northern Ireland which would make him a British citizen. Do you think that will make things more difficult or do you think that he will have to do go Dublin anyways.

Not trying to be funny, just recalling from memory.
As long as there is an I-134, you both should be good.

Do you know where about the consulate is in London?

What about the I-134 forms, I mentioned it above but I'm not sure if you caught the tail end of it.
 
So we should be good even though I don't have a job? My dad does and he make like $75,000 a year...he is the one who said he would support him. I'm not trying to be annoying, it's just a concern of mine. If his dad fills out an I-134 will it help? Thanks for everything!
 
When I send in copies of the birth certificates, do they have to the the certificates from the country recorders office or can I photocopy the certificates and send those in? I read somewhere that I could photocopy them.
 
As you are at the beginning of the process and submitting your petition, then you should only provide photocopies.

As far as Im aware and according to this guide, originals of the copies that you have included in your petition should accompany the beneficiary to the interview.
