Just talk to an IIO

The IIO told me that they are not sending FP notice out for applicant from India and China before the application reaches the processing officer\'s desk any more. The FP notice will be sent out by the processing officer when he starts to process the application and he will keep processing the case while the applicant is doing FP. He told me that it only takes 2-3 days for them to get the FP results so that my case will not be delayed because of the late FP notice. And they start to process ND Sep/1999 cases now. And the applications is processed in the order of I485 ND date regardless of FP status.
I do not feel good about it but he said this is their policy now because of the lack of the man-power.
Does anyone gwet similar answers from IIOs? I just want to make sure it is the real policy because I keep hearing that people get FP notice for very late ND dates.

Good news for Oct/99-Mar/00 from India/China. BTW, do you ask about your specific case? When do you expect your FP?

I heard same thing from my lawyer today. He said they have inquired INS about the issue of FP for ND 10/99 to 04/00 cases, the answer from INS basically is that ND 10/99 filers will get FP once the case is under review of an IIO.

My detail ND 10/01/99 RD 09/17/99 EB2 China. no FP. The sad thing for me is I see a case online, whose detail is exactly like me(ND 09/30/99 RD 09/17/99 EB2 China), but ND is one day early than me, which make he fell in September ND, and he got approved back in October 2000.

It’s good to know that INS will process the cases with RD dates, though it’s sad for us not receiving FP normally as other people do.
